1. AGREEMENT TO TERMS

Welcome to Forumla.us (the “Forum”), operated by LocalAd.com (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our Forum and constitute a legally binding agreement between you and LocalAd.com.

By accessing or using the Forum, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Forum.

Community Violations:

  • Impersonate another person or entity
  • Harass, stalk, or intimidate other users

  • Engage in any form of discrimination or hate speech

4. USER CONTENT AND INTELLECTUAL PROPERTY

Your Content Rights

You retain ownership of content you post to the Forum (“User Content”). However, by posting User Content, you grant LocalAd.com a non-exclusive, royalty-free, worldwide license to:

  • Display, reproduce, and distribute your User Content on the Forum
  • Moderate, edit, or remove your User Content as needed for Forum operations
  • Use your username in connection with your User Content

Content Responsibility

  • You warrant that you own or have necessary rights to post your User Content
  • You are solely responsible for your User Content and any consequences of posting it
  • We do not endorse or guarantee the accuracy of User Content

DMCA Compliance

If you believe content on the Forum infringes your copyright, please contact us at admin@localad.com with:

  • Description of the copyrighted work
  • Location of the infringing content
  • Your contact information
  • Statement of good faith belief that use is unauthorized
  • Statement that the information is accurate and you are authorized to act

5. MODERATION AND ENFORCEMENT

Content Moderation

  • We reserve the right to monitor, review, and moderate all Forum content
  • We may remove content that violates these Terms at our sole discretion
  • We are not obligated to pre-screen content but may do so

Account Actions

We may take the following actions for Terms violations:

  • Warning: Notification of Terms violation
  • Temporary Suspension: Temporary loss of Forum access (1-30 days)
  • Permanent Ban: Permanent loss of Forum access
  • Content Removal: Deletion of specific posts or content

Appeals Process

If your account is suspended or banned:

  1. You may appeal by emailing admin@localad.com within 30 days
  2. Include your username and reason for appeal
  3. We will review and respond within 14 business days
  4. Our decision on appeals is final

6. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Forum, you consent to our Privacy Policy.

Data Retention: We retain user content and account information for as long as your account is active, plus 90 days after account closure.

7. THIRD-PARTY LINKS AND SERVICES

The Forum may contain links to third-party websites or services. We are not responsible for:

  • The content or practices of linked websites
  • Any transactions you conduct with third parties
  • The privacy policies of external sites

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCALAD.COM SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, punitive, or consequential damages
  • Loss of profits, data, or use
  • Damages arising from User Content or user interactions
  • Service interruptions or technical issues

Maximum Liability: Our total liability shall not exceed $100 or the amount you paid to access the Forum (if any), whichever is greater.

State Limitations

Some jurisdictions do not allow limitation of implied warranties or liability for incidental damages, so these limitations may not apply to you.

9. TERMINATION

By You

You may terminate your account at any time by contacting admin@localad.com.

By Us

We may terminate or suspend your access immediately, without notice, for:

  • Violation of these Terms
  • Illegal activity
  • Requests by law enforcement
  • Technical or security reasons
  • At our sole discretion

Effect of Termination

Upon termination:

  • Your access rights end immediately
  • We may delete your account and User Content
  • Provisions regarding liability, indemnification, and disputes survive termination

10. MODIFICATIONS TO TERMS

We may modify these Terms at any time by posting updated Terms on the Forum. Changes are effective immediately upon posting. Continued use of the Forum constitutes acceptance of modified Terms.

For significant changes, we will provide 30 days’ notice via Forum announcement or email.

11. GOVERNING LAW AND DISPUTES

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Jurisdiction

You agree to the exclusive jurisdiction of state and federal courts located in Florida for any disputes arising from these Terms or Forum use.

Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes through good faith negotiation by contacting admin@localad.com.

12. GENERAL PROVISIONS

Entire Agreement

These Terms, together with our Privacy Policy, constitute the complete agreement between you and LocalAd.com regarding the Forum.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.

Force Majeure

We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, government actions, or technical failures.
